Parents are often in the difficult situation of choosing who will provide child care for their children while they are at work. Unfortunately, some parents in New York and across the country learn that the faith they placed in the person who is caring for their child is misplaced. In fact, a child care provider in another state was recently sentenced to prison after she was accused of causing a head injury to an infant in her care.
The incident that ultimately led to her arrest and conviction happened on a day in Jan. 2017. The 27-year-old woman reportedly called 911, claiming that the then 4-month-old was unresponsive and vomiting. The infant’s injuries left him blind and with brain damage.
Doctors diagnosed the boy with abusive head trauma. One doctor reportedly told police officers that the type of injuries that the infant suffered — including bleeding in the back of his eyes and in three separate locations of his brain — are only caused by intentional physical trauma. The woman charged with aggravated battery testified that she did not injure the baby, but she was convicted in January and recently sentenced to over seven years behind bars.
Knowing that the woman who caused their child’s injuries is being held responsible for her actions could provide the child’s family some sense of closure. However, the costs of caring for the young child due to his head injury may be more than they can handle. As a result, many parents in New York whose child was injured as a result of the actions of another often choose to seek information on all their legal options, potentially including filing a personal injury lawsuit against the party deemed responsible.
