Parents in New York and across the country send their children to school every day. By doing so, they put their trust into educators and other school workers to both educate and protect their children’s safety. It is understandable, then, that parents would demand answers if their child suffered a head injury while at school.
In fact, a family is doing just that. According to the parents, they sent their 8-year-old son, a third grader, to school on a day in January. Apparently while in gym class, the child suffered an injury to his head.
Reports indicate that the injury necessitated emergency brain surgery. Though he is at home now and said to be in good spirits, his family reports that he is experiencing memory loss. Despite the apparent severity of the child’s injury, the exact cause is unclear. The family claims that the school has not communicated with them.
It is reasonable to expect that a child will be kept safe while at school. Unfortunately, a lapse in supervision, poor property conditions and faulty or damaged equipment could ultimately result in an injury, such as the head injury reportedly suffered by this young New York student. Often an injury such as this has a long recovery with some symptoms staying for an extended period of time. If an injury is the result of another’s negligence, victims and their families may choose to file a personal injury lawsuit against the party or parties deemed responsible. If successfully presented, the plaintiffs could receive a monetary award that will help ensure that the victim receives necessary medical treatment.
