Children in New York and across the country send their children to school every day trusting that they will be kept safe. Unfortunately, not all children will make it home in the same condition in which they left, while others may not be able to return at all. In fact, a young student in another state recently suffered a fatal child injury while at an elementary school.

The incident reportedly happened one afternoon on a day in May. The 9-year-old victim is said to have been attending a School Age Child Care program. Unfortunately, reports indicate that the victim pressed a button that would cause a large motorized partition dividing the school gym to open.

As a result, the student reportedly become trapped between the partition and a wall, resulting in a traumatic brain injury. He was transported to the hospital, but he passed away later that day. An autopsy revealed that the boy’s death was accidental. Reports indicate that criminal charges are not expected to be filed.

Now a family is left facing the tragic and unexpected death of their family member. What they felt was a safe environment for their child turned deadly. Many people in New York who have lost a child to a child injury such as this choose to explore their legal options, potentially including filing a civil lawsuit. An attorney with experience with such cases can help determine who may be considered at fault, in this case potentially including the school and personnel as well as the manufacturer of the partition.
